See, but I'm a bit uncomfortable with having legal terminology drive all of our theoretical and philosophical discussions. I actually don't wanna go back to derivative as a term, but I want to get out of transformative being the only point we are concerned with, if that makes sense.

I agree that none of these analogies work perfectly, but I was trying to point out how there are aspects of each that relate....I agree that it is a performance, but it also involves editing and other words that are more related to other fanworks...

Re permission. I think it's all over the place now, but given the history I've been sketching out and the changed in fan cultures I's expect it to be moving toward less rather than more...
